ButterflyKi LLC d/b/a Lisa Finn Hypnosis & Wellness (“Lisa Finn Hypnosis & Wellness,” “we,” “us,” or “our”) provides the services described below. Please read these Terms & Conditions (“Terms”) carefully.
1. ACCEPTANCE OF THESE TERMS
These Terms govern your use of www.lisafinnhypnosis.com, your booking of consultations, your purchase or use of products and services offered by Lisa Finn Hypnosis & Wellness, and your access to REBOOT and other digital programs we may offer (collectively, the “Services”).
By using the website, submitting a booking or form, purchasing a product or service, creating an account, or accessing a digital program, you agree to these Terms and acknowledge our Privacy Policy.
Private hypnosis services are also governed by the client documents you receive and sign, including the Client Bill of Rights and other service-specific paperwork. If a provision in signed private-client paperwork conflicts with these general Terms with respect to private services, the signed client paperwork will control for that issue.
2. ABOUT OUR SERVICES AND SCOPE OF PRACTICE
Lisa Finn Hypnosis & Wellness provides nontherapeutic motivational and meditative coaching, hypnosis, self-hypnosis instruction, guided relaxation, educational programs, and personal-development resources.
Our services are not medical care, psychotherapy, psychology, psychiatry, counseling, diagnosis, or treatment, and they are not a substitute for care from a licensed healthcare or mental health professional.
We do not diagnose, treat, prescribe for, or cure medical or mental health conditions.
If you are receiving medical, psychological, psychiatric, or other licensed healthcare services, you should continue to follow the recommendations of your qualified provider. Do not discontinue prescribed medication or treatment without consulting the appropriate licensed professional.
Our Services are not intended for emergencies. If you believe you or another person may be in immediate danger or experiencing a medical or mental health emergency, contact 911 or the appropriate emergency service.
3. CONSULTATIONS AND ACCEPTANCE AS A PRIVATE CLIENT
A consultation is an opportunity to discuss what you would like to change, learn about our approach, and determine whether our services appear to be a good fit.
Booking or completing a consultation does not guarantee that we will accept you as a private client.
We may decline or cancel a consultation or decline to provide private services when the requested work is outside our scope, when another type of professional care appears more appropriate, when required information is not provided, or when we otherwise determine that the working relationship is not an appropriate fit.
Prospective clients may be asked to complete follow-up questions before a consultation is considered confirmed. Failure to provide requested information may result in cancellation or rescheduling of the consultation.
If we believe another professional may be better suited to your needs, we may suggest that you seek services elsewhere. Any referral or suggestion is provided as a courtesy and is not a guarantee or endorsement of another provider’s services.
4. PRIVATE HYPNOSIS SERVICES
Private hypnosis services are governed by the client paperwork provided in connection with those services.
That paperwork may address fees, packages, scheduling, cancellations, refunds for unused prepaid sessions, confidentiality, recordings, scope of practice, and other matters specific to the client relationship.
Hypnosis is a collaborative process. Your participation, willingness to engage in the process, practice between sessions when requested, and other individual factors can affect your experience.
No particular result, timeline, or outcome is guaranteed.
Fees shown on the website or discussed during a consultation may change from time to time. The fee and package terms applicable to your private services will be those communicated to you at the time you purchase or begin the applicable service.
5. REBOOT AND OTHER DIGITAL PROGRAMS
REBOOT and our other digital programs are educational and personal-development programs.
They may include videos, hypnosis recordings, worksheets, written exercises, demonstrations, live group calls, and other learning materials.
Digital programs do not provide medical or mental health care and are not a substitute for diagnosis, treatment, psychotherapy, counseling, or other licensed healthcare services.
REBOOT is intended for adults age 18 and older unless we expressly state otherwise.
Use hypnosis recordings only when you are in a safe place where you can relax without interruption. Never listen while driving, operating machinery, exercising, or performing another activity that requires your full attention.
REBOOT is not intended to collect medical records, diagnoses, treatment information, medication information, protected health information, or other sensitive health information through the app.
If an interactive feature allows you to enter reflections, use that space for personal-development reflections and do not enter medical diagnoses, treatment or medication information, or other sensitive health information.
6. ACCOUNTS, ACCESS, AND ACCEPTABLE USE
Digital program access is provided to the individual purchaser or authorized user and is for personal, noncommercial use only.
You may not:

Share your login credentials with another person;

Allow another person to use your account;

Resell or transfer access;

Copy, reproduce, distribute, or republish program materials;

Use program materials for commercial purposes without permission; or

Use the Services to create a competing product or service.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
Please notify us promptly if you believe your account has been accessed without authorization.
We may suspend or terminate access if we reasonably believe an account is being shared, used unlawfully, used to infringe intellectual-property rights, used to harass or harm others, or otherwise used in violation of these Terms or applicable platform rules.
7. WORKSHEETS, USER CONTENT, AND GROUP FEATURES
You may choose to complete digital-program worksheets in the app, in a Google Doc you control, on printed worksheets, or in your own journal or notebook.
If you create and save a copy in your own Google Drive, that copy is controlled by you and is subject to your relationship with Google unless you separately choose to share it with us.
If you submit comments, messages, reflections, feedback, reviews, testimonials, or other content through a Service, you remain responsible for what you submit. You should not submit information you do not have the right to share.
Live group calls, communities, or similar group features may include other participants.
Please do not disclose information you do not want other participants to hear or see. We may ask participants to respect one another’s privacy, but we cannot guarantee that other participants will maintain confidentiality.
If a live group session or event is recorded, participants will be notified as appropriate.
8. RECORDINGS, TRANSCRIPTS, AND AI-ENABLED TOOLS
Consultations and private sessions may be recorded or transcribed as described in our booking process, client paperwork, and Privacy Policy.
Where applicable and after the appropriate consent has been obtained, we may use AI-enabled tools to assist with transcription, summarization, or organization of information for internal service-support purposes.
Our Privacy Policy explains these practices in more detail.
A general acceptance of these Terms is not intended to replace any separate consent that we request for sensitive-data processing, recording, transcription, or AI-assisted processing where separate consent is required.
9. PAYMENTS
Prices are stated in U.S. dollars unless otherwise indicated.
Payments may be processed by third-party payment processors or platforms, including providers used by Wix, Passion.io, Stripe, PayPal, Venmo, or other processors we may use from time to time.
You agree to provide accurate billing information and authorize the applicable payment provider to process charges you approve.
We do not intend to store complete payment-card numbers on our own systems.
You are responsible for any taxes, fees, or other charges that are lawfully applicable to your purchase unless we expressly state otherwise.
10. REFUNDS, CANCELLATIONS, AND DIGITAL PURCHASES
Private-service cancellation, package, and refund terms are governed by the client documents and purchase terms provided for those services.
Digital Products and Programs
Because REBOOT and other digital products provide immediate access to digital content, all digital product and program sales are final and non-refundable once access has been provided, except where required by law.
If we offer a subscription, membership, automatic renewal, or other recurring-payment service in the future, the recurring price, frequency, renewal terms, and cancellation method will be disclosed before purchase.
Recurring charges will not be imposed without the authorization required by applicable law.
11. INTELLECTUAL PROPERTY
Unless otherwise stated, the website, REBOOT, digital programs, hypnosis recordings, videos, worksheets, written materials, graphics, logos, program names, and other original materials made available through the Services are owned by or licensed to Lisa Finn Hypnosis & Wellness and are protected by copyright, trademark, and other intellectual-property laws.
Purchasing or accessing a Service gives you a limited, personal, nonexclusive, nontransferable license to use the materials for your own personal use.
It does not transfer ownership or give you permission to copy, reproduce, publish, distribute, sell, sublicense, create derivative commercial products from, or publicly display the materials except with our written permission or as otherwise allowed by law.
Certain third-party materials, names, techniques, or content may be used under license or with attribution and remain the property of their respective owners.
12. TESTIMONIALS AND RESULTS
Testimonials and examples describe individual experiences. They are not promises, guarantees, or representations that you will achieve the same or similar results. Hypnosis and personal-development outcomes vary from person to person.
Results depend on many factors, including the individual, the issue being addressed, participation, practice, circumstances, and other factors outside our control. No specific outcome is guaranteed.
13. ELECTRONIC COMMUNICATIONS
When you book, purchase, create an account, or use a Service, we may send transactional or administrative communications that are reasonably necessary to provide the Service. These communications may include booking confirmations, reminders, account notices, access instructions, receipts, and service updates.
Marketing emails and newsletters are sent in accordance with the preferences and consents you provide.
You may unsubscribe from marketing emails using the unsubscribe link in the message or by contacting us. Unsubscribing from marketing communications does not prevent us from sending necessary transactional or service-related communications.
14. PRIVACY
Our Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with the Services.
The Privacy Policy is incorporated into these Terms by reference.
Where applicable law requires separate affirmative consent for sensitive information or another particular processing activity, we will request that consent separately rather than relying solely on acceptance of these Terms.
15. THIRD-PARTY PLATFORMS, LINKS, AND SERVICES
Our Services rely on or may link to third-party services and platforms, including website hosting, booking, video conferencing, digital-program hosting, payment processing, email, document, analytics, and other technology providers.
Your use of a third-party platform may also be governed by that provider’s terms and privacy practices. We do not control third-party services and are not responsible for their independent acts, availability, security, content, or policies.
REBOOT is currently delivered using technology provided by Passion.io. Passion.io provides the platform infrastructure; Lisa Finn Hypnosis & Wellness is responsible for the content and the relationship with REBOOT users.
16. SERVICE AVAILABILITY AND CHANGES
We may update, modify, replace, or discontinue features, content, or technology used to provide the Services.
Digital platforms and third-party services may also change their features or availability.
We do not guarantee that the website, app, recordings, downloads, or other digital features will always be uninterrupted or error-free.
If a technical issue materially interferes with access to a paid Service, we will make reasonable efforts to restore access or provide an appropriate alternative, subject to the circumstances and applicable law.
17. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the website and digital Services are provided on an “as is” and “as available” basis.
We do not make warranties that the website or digital Services will be uninterrupted, error-free, or suitable for every person or purpose.
Nothing in these Terms is intended to disclaim a warranty or consumer right that cannot lawfully be disclaimed.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Lisa Finn Hypnosis & Wellness and ButterflyKi LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the website or digital Services.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Your rights under applicable consumer-protection law are not waived by these Terms.
19. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except to the extent another jurisdiction’s consumer-protection law must apply.
Any dispute arising from these Terms or the Services that is not resolved informally will be brought in a court of competent jurisdiction in Connecticut unless applicable law requires otherwise.
20. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our Services, business practices, technology, or legal requirements.
The “Last Updated” date will identify the most recent revision.
Changes will apply prospectively.
When required by law, or when a change materially affects an existing paid relationship, we will provide additional notice or request renewed agreement as appropriate.
21. GENERAL TERMS
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Our failure to enforce a provision does not waive our right to enforce it later.
These Terms, together with the Privacy Policy and any applicable purchase terms, program-specific terms, or signed private-client documents, form the agreement governing the applicable Service.
In the event of a conflict, the more specific terms for the applicable Service or purchase will control.
